Human Rights Instruments

 

Torture is prohibited by both international humanitarian law and numerous international human rights instruments. The prohibition of torture is absolute. No circumstance can ever be invoked to justify its use. In the words of article 74 of the first additional protocol to the Geneva Conventions (Part 1, p.61): “Torture…is and shall remain prohibited at any time and in any place whatsoever”.

 

The fact that many governments continue to practice or tolerate the unlawful practice of torture makes the efforts to raise awareness of the prohibition of torture, and the possibilities for prevention crucial.

 

Under this section, you will find a selection of legal instruments that may be used in the course of torture litigations to validate the obligation of states to ensure that torture shall be prohibited at all times.
